  • Killing Spree 76 Miers Withdraws: Who Will Bush Pick Next?

    Bush is going to want to slink out of this mess with as little noise as possible, and to do that he'll have to find someone that he can be darn sure of getting solid Republican support on. Someone that's not too moderate for the fundies, and not too fundy for the moderates. And also someone that's accomplished enough in Constitutional law that they won't upset those in the Senate that actually care about accomplishment. Really, what he needs is another John Roberts. Is there another one out there? I'm not seeing any that are likely to glide through the way Roberts did. Probably conflict is inevitable. We'll see what happens when Bush throws down his next hand.

  • 75 Bad News: A week of death, destruction, doom, and denial

    The world is a terrible place. Too often reporters are inclined to focus on the 'good,' on supposedly 'positive' developments. Too often the bad news is not given the attention that it deserves. Besides, sooner or later the sun is going to explode. Here are just a few of the stories that made this week cruddy.

  • 74 Harriet Miers: Policy or Principle?

    Miers will not 'move the court' in the way that conservatives might wish, and she certainly won't be a leader, but the Supreme Court has got leaders. How many grandiose theories of existence can it support at the same time? I'm perfectly to happy to have her there, not making too much trouble. If anything Miers has shown herself to be cautious. Perhaps because of her lack of some over-arching philosophy on the Constitution, she will take some time to figure out what the Court's rulings will do to people 'on the ground.' That's good enough for me.

    When the protest was over, both sides had yelled, exchanged pamphlets, rung bells, quoted the Bible, and played sirens. What neither had done was listen to the other. Eventually both groups retreated from the streets and returned to their homes and churches, preparing to battle on another day.
