Ann and Nancy Wilson of the rock group "Heart" infuriated at the use of their '70s rock anthem.

It seems that the Republican National Convention and Presidential hopeful John McCain tried to take America to “heart”, and Heart stated in no uncertain terms that they didn’t want their “heart” stolen. Apparently Alaska Governor Sarah Palin was given the nickname “Sarah Barracuda” whilst a star high school basketball player, referring to Heart’s 1977 rock hit, prompting the RNC to use the song as her theme music at the Republican convention.…

    Sorry, Jet, saw you had mentioned those other artists already. I read the piece quickly and was writing quickly to support you. As an artist I agree that copyright infringment is an important issue.

    I had read about the other artists earlier, and when read the Heart addition, I could not believe it: another example.

    It seems bizarre that the Republicans don't get that using someone's art without permission is just plain illegal. I have to assume that getting permission from the artist before they sell their work is part of the process. If it isn't, then artists absolutely need new contracts. I certainly would wish a say so before my work was used for causes I did not feel comfortable with. In any case, those artists have a right to protest.

    Dave, Canon, whether an artist's career is moribund or not current, is so beside the point; plenty of older artists still have fans. Good music lasts.

    And Arch, as you have been censored numerous times, please take Eric's words to heart. You write nothing original, cite no sources, do no original research and spend no time on pieces or columns. All you do is sit down and type, ungrammatical and often illogical posts, which sometimes misuse words in very amusing ways, and which often result in mean and ugly personal attacks.     Cathy has the key bit of information here which seems to be getting ignored. The RNC went to ASCAP and in fact PAID for the use of the music. Artists sign up with ASCAP so that it can handle licensing permissionw without having to involve them directly. It would be unbelievably impractical if everyone who used a given song contacted the musicians directly.

    So, after having agreed to let ASCAP handle the licensing of the music, and after ASCAP treated the RNC just like any other licensee as they should have, the musicians want to go outside of the system which THEY signed on to, to place special conditions on the RNC after the fact.

    That's just unreasonable, and it probably isn't legal even under the new copyright law. It certainly seems inconsistent with normal contract law.

    As for Heart's complaint that people will draw conclusions about their political beliefs based on the use of the song, that's just ego talking. No one gives a moment's thought to the artists behind a snippet of music played while someone walks on stage. The Wilson sisters suffer under the delusion that people care what they think. No one does.

    As I said before Dave, ASCAP controls public domain, If the RNC sold DVDs of the convention in order to raise money, then they'd have to get permission from the owner of the music.

    This is why Michael Jackson purchased the entire Beatle's catalogue, because he'd make income from it's use in venue not controled by ASCAP.

    Also there's the case of Jackson Browne, who controls permission of his work so that none of it can be used in commercials. ASCAP allows it to be broadcast, but does not control the material as it pertains to profit making persuits.

    As for use of the sister's photo, I'm not making money on it's use. It's the same as U-Tube having Heart's video-they're not making money selling "the best of "Heart".

    I already answered the question Gary. the RNC makes commercial revenue, and if the DVDs are sold of the event for fundraising purposes, then Heart deserves their cut, and deserves to control where it goes and for what purpose.

    Dave's fonts are sold on a basis that they can be used wherever and whatever the purchaser wants to use them for. Unless he specifies that in the sale contract, he has no business/right objecting to its use.

    Heart specifically witholds that use and retains its control. That's why you see all that fine print on CD/DVDs that says this material may not be used for commercial use without the express permission of the authors.

    Try (if you can) to make a useful contribution to this string or fuck off. You're getting terribly boring...

    But Jet, BC in fact IS making money off the use of the photo. We just generally get ignored for doing it. Photos enhance the articles, the articles draw users and users look at the advertising and provide revenue. Therefore the photos are used to make money. Not much, but they're part of the process.

    As for ASCAP, their license specifically applies to the kind of public performance of music which takes place at events like the RNC. If they paid their ASCAP fee, as has been established here, then the artist has no say in the matter. If they later release a DVD of the convention then additional terms would need to be negotiated.

    Jet, I haven't commented on Heart's music at all. I just said that their career wasn't exactly booming right now. I find their music enjoyable. My daughter keeps playing it on her ipod in the car and I don't object.

    Dave again, Heart controls where and when their music is used-they have not sold that aspect of their ownership to another investor. Regardless of what ASCAP controls-Heart controls that, otherwise an investor could not come in and purchase those rights.

    Jackson Browne controls the rights to his materials to the point that he has retained the authority to control who it's used by-otherwise he couldn't sue the RNC for their unauthorised use.

    Mike Myers controls the ownership of his "Wayne's World" characters. Someone has to pay him in order to use those characters for profit.

    Eddie Murphy made a fortune with his Mr. Robinson's Neighborhood character, but he had to pay Fred Rogers or get his permission in order to to a send-up of "Mr. Roger's Neighborhood" because Fred owned them, they were not in the public domain.

    Sorry to disillusion all of you, but it is my policy to acknowledge everyone who is nice enough to bother leaving a comment-be it positive or negative.

    I do this OUT OF GRATITUDE for your input, and not in some vein effort to always have the last word, or (as Sussman has deluded himself into believing) to run up some stupid comment count.

    I've posted comments on other strings and when they weren't acknowledged I got the impression that my opinion wasn't valid or was being ignored, so I make sure everyone that posts, gets a thank you-be it an "I appreciate your point of view" or a heartfelt "fuck off".

    I just found this particular topic so thouroghly uninteresting.

    For the record I agree with you. I don't understand the ins and outs of copyright law but if Heart does have exclusive rights to all of their music then they have a legitimate gripe.

    I'm just so sick of actors and musicians taking themselves way too seriously and lecturing the rest of us on the realities of our world.

    I promise the next time you write an article that is interesting than staring at paint that's already dried I will just mosey on along to the next article without leaving a comment.

    Fair enough.

    Just a thought on what really matters

    In the movie Jerry McGuire, I believe it was “show me the money”, in politics (poly-ticks = polyester + bloodsuckers herein referred to as pt’s) and power it becomes follow the money. The old Cliché “Power corrupts, absolute power corrupts absolutely” always seems to be apparent when you step back and try to determine the hidden agenda of the proposal being put fourth by the presenter.

    Example:

    How much did cigarettes cost before the government went after the Tobacco Companies, moreover, what do they cost now? How do they spend the revenue? Not always for the intended purpose as the proposal was put fourth by the presenters, seemed like a good idea at the time, but it gives them power with possible legitimacy and position to move to the next great cause to exploit. I.e. Drug Companies., Insurance Companies, Doctors, Baseball, Football, Microsoft even Religion you name it they will find it; you will love this yes-even prohibition, now that one worked!

    Their cohorts in all this is the “illegitimate in birth” talking heads and media who present it in such a way they even start to believe their own rhetoric, and when they start having to defend their position the result is madding. The extremes on both sides always seem to gain a platform in which to further their agenda. I believe that is called denial and I wonder if an intervention would help, you know what I mean. One cause of the oil crises is the various groups of people now in position to tell us to inflate our tires, drive less, and sue or tax the oil company’s (same-thing). I wonder how many flew home burning all that fuel while we were tuning our cars and checking tires and filling our tanks with $$$ gasoline.

    The scary part the pt’s are involved in everything even without expertise in the subject armed with only what someone with and agenda or incoherent truth (the list is to broad to inject here) is feeding them. Question, would they perform brain surgery on themselves if someone convinced them they could. In other words it is like me trying to write this note, it is quite apparent I do not have the skills. Even with spell-check, the sentence structure must be quite laughable; I cannot see it, can they see theirs?

    Here is the solution. The American people need to use their common sense, dig deeper and lead the slick media; pt’s etc it is our right and let us not forget what makes this nation great, trust and verify everything. As the price of oil drops in the interim, do not become lax we are cooking frogs here, keep the heat on the pt’s and “elect leaders” for this country, which is going to be a feat in itself, as there do not seem to be any in sight. The only solution may be an end run with a T-Boone or the ex Shell CEO, the likes of a Gates, Jobs, someone creative and not a victim, again watch the agenda follow the money, and dig and vote.

    “In the end we the people in charge are paying for all this. The questions are we getting what we are paying for, or what we deserve because we are not paying attention”.
    “We may not be able to drill our way out of this but we can Vote our way out of it” now there’s a thought We have until November to study for the final exam; if we fail then we will have to take the class over. I ask what the price will be then.

    Jet, I love you but I think we have a few more serious problems than the Wilson sisters whining about a song. I'm so tired of both sides yelling and whining and I have been one of the most guilty. Get a grip, folks. Anyone watching the news today should be concerned about the Feds taking over Fannie MAE and Freddie MAC but that story doens't mean much to most of us. But, if you took the time to look at their political action committees and the amount of money that was dumped into the campaigns of key members of Congress you might just get as pissed off as I am.

    There are three priorities in this election for me:

    • REAL education reform, not just talk. And part of that reform includes ethics and accountability for teachers, parents and students themselves. And let's teach Creationism along side evolution and any other theory that's around. That is what schools are for. To encourage the thinking processes. To encourage debate and reasoned analysis of the lessons of history. We must make education something that children crave instead of Oreos, Nintendo games and Nickelodeon.

    • REAL election reform that strikes a fatal blow to lobbyists and special interests. Obama supporters, if you believe community activism is a qualification to be President then put your money where your mouth is. I agree -- community activism which produces concrete, positive results IS a bono fide qualification to be President. The far right better back off. Jesus was an activist and He became the Messiah. Get over yourselves.

    • REAL environmental reform that includes a comprehensive energy plan that uses what resources WE have available in this country first. Let's drill for 20 years on the Northern Slope. And, in the meantime, let's put our people to work creating alternative sourecs of energy. You want jobs, America? Make the government go green and you'll start making the green once again.

    By taking these three issues head on, it sends a message to the rest of the world that we're serious and we're doing something about it.

    You want to scare the terrorists in the Middle East? Tell them the money is staying right here in the United States. Just as we are dependent on their oil, they are dependent on OUR money. Or haven't any of you figured that out yet? Every time we pump a gallon of gas we're letting the terrorists win. Wake up and smell the Columbian coffee. Stop whining and get busy turning this country around before our kids have no country left to call their own.

    Did the RNC pay the licensing fee?

    If they didn't, the Heart have grounds for legal action, which would be advisable to pursue with vigour, since the RNC has a lot of deep-pocket friends who'll replace the monies won quickly.

    BUT...if they did, then Heart should shut up and collect their money, and be glad that nobody's forgotten them. You know, like The Pretenders finally did with Rush Limbaugh's show.

    And Jet, yeah, I think it's rude of the RNC to play the song after being asked not to, but I gotta wonder who owns the rights to public peformance of it, and whether the appropriate fees were paid by the convention, with the sum result that the RNC would feel comfortable doing this.

    After all, they could've gotten Ted Nugent, and he probably wouldn't have even charged more than cost.

    I'm just wondering, Jet. Did Al Smith pay some Irish writer a fee to use "East Side, West Side" back in 1928? Did Roosevelt pay the writer of "Happy Times Are Here Again" in 1932? the writer was very much alive in 1932 - unless he overbalanced himself from a window on finding he was broke....

    Go read the book "1929" to learn the history of that second song, Jet. The book makes interesting reading generally, but the stuff about that song is well, just heartbreaking.

    I understand your point about these aging women not wanting their song used by Sarah Palin - but truth be told, her use of the song will benefit them more than they realize, and since making money as an artist is not easy - as I don't need to explain to you - they can use the scratch.

    Well, Jet, you're right - to a point. I know you're a Reagan hater but I remember those days all too well. The Democrats figured as long as they held the majority they could stop Ronald Reagan's agenda and they learned quickly that this President wasn't going to play their game. Tip O'Neil respected Ronald Reagan because he was a President that had no problem bypassing Congress and reporting to the American people. That strategy paid off big in the first Reagan term. Congress crumbled. And we need a President who is willing to go that extra step once again. Obama or McCain possess those qualities. Regardless of which man is elected, I believe that they have the character to put America first over the interests of Congress.

    Congressional approval ratings are LOWER than those for the incumbent President. Think about it. Members of Congress are flying under the radar. They're scared shitless that we are going to shift the focus to Congressional elections as opposed to Presidential. The sitting Congress has been the most ineffective in our history. The Democrats were banking on doing nothing by allowing George W. Bush to tank in the American consciousness. The only thing Congress was successful at executing this session was taking the blame off themselves.

    And now, let me drive the point home. There's a mortgage crisis. The Federal government is about to take over and bail out Freddie MAC and Fannie MAE. But why should we care? Take a look at some of the people who got cash from the FEDERAL HOME LOAN MORTGAGE CORPORATION POLITICAL ACTION COMMITTEE AKA FREDDIE PAC in the 2007 - 2008 election cycle to date:

    A good place to start is to actually leave the Middle East. The United States' constant military presence in parts of the world in which it doesn't belong is producing more terrorists by the day, as people in those parts of the world consider America an invading, unwelcome force.

    Quite the contrary, I happen to adore it. I'm more opposed to bitter foods with entitlement issues and bizarre ingredients.

    I think the RNC was chanting "DRILL BABY DRILL," which just sounded odd in the context of the whole Sarah Palin thing.

    But I digress...

    I do think the United States needs to look into drilling inside its own borders and use the oil facilities it has more. They're using more Canadian oil than Middle Eastern oil, though, and that should be filtered off too. My concern for the U.S. isn't some attack or some far-off hypothesis based on years of wonky Zionist "prophecy."

    My main concern is that the average American has lost his or her sense of innovation, creativity, and compassion. America used to be a country of inventors and innovators, now it's just a country of consumers. And that consumption has led a lot of people into bad situations and, worse still, has turned America's interests inside out. I think America and Canada can once again partner together with pride and start innovating things for North America instead of merely consuming the resources of other countries. Shit, I love America and Americans. I bloody well married one, for Christ's sake.

    I want nothing more than to see both Canada and America do well in the world, have more compassion for other countries that aren't just strategic allies (Saudi Arabia, Israel, etc.), and generally play more of a peacekeeping role. America should pull all or most of its troops in, take its military presence out of most countries, and let these regions of the world fight their own battles. When the battles ravage the land and the people, America, Canada, and other countries can actually band together to help out. But we shouldn't be making it worse with an insane desire to "win" conflicts that no longer have no victory. Today's wars, it seems to be, aren't so black and white.

    So yeah, if you take nothing else from my idiotic ramblings in the politics section (remember, I'm a music and movie critic), take that.

    Jordan, we don't need Canadian peacekeepers either. We're quite good at keeping the peace if we don't have to worry about your interference. If you are truly intelligent, lay off the sauce for a while and do what you can to pressure your M.P in Ottawa to get your boys out of Aghanistan. You'll do your country and yourself a big favor.

    I've personally discussed quite a few issues with my MP here, including Afghanistan. However, he's a conservative. Being a supporter of the NDP, my party may never find office in Canada, but they will almost always oppose our "mission in Afghanistan." It's pretty well known that the majority of Canadians want our men and women out of there and back home ASAP.

    Does that make me "truly intelligent" in your esteemed proclamation? Pretty please?

    I agree we have more serious issues. Like making sure our candidates don't lie, cheat, steal, mispresent themselves or do the same about the other side and their record. Which is why I posted a complete parsing of Palin's speech on my Johhny/Spalinin' piece as a comment in response to one of Condor's and have also done so in response to comments of Clavos'. There is plenty of good, solid information available in both newspapers and on the internet so that one can make the decision as to whom to vote for based not on the viscera but with the brain.

    I, personally, find it egregious that one of the current nominees for veep lied every step of the way during her speech (written by the talking heads of the party) but that afterwards all the media could do was coo and bill. And that it took days for her to be parsed.

    I will once again paste the information here for those of you who wish to take, perhaps, one half hour to read.

    I might also remind you that John McCain has spent far more time reminding us of how long he lived in a box than he has telling us what he will and won't do when he goes to DC as our president (as opposed to the past TWENTY SIX YEARS he has already spent there). I might also remind you that, until Thursday night, the word change was not in his sloganeering vocabulary, and that he is just now trying hard to distance himself from Bush, when not too long ago he was enveloping him in a bear hug and voting with the Republicans (whose platoform Dave and Clavos assure me he does not support) ninety percent of the time for the past eight years.

    If any of you wish to call this merely emotional writing, then there is nothing left to say to you. You will continue to write your angry and unfounded replies and comments that claim that nothing said in any of the columns has any evidence of anything.

    But if you read and think and compare reality to what is merely being said by people you don't like, then, perhaps, something may get through.

    It is sort of like being a grown up and loving Hemingway's literature even though you don't particularly like the man, or Norman Mailer's writing even though you don't always agree with him and loathe the fact that, in a fit of anger, he stabbed his wife with a penknife. I don't really care what you think of me. But I do provide you with places you can look things up. I do head you toward sources from which you can then head toward other sources. I won't spoonfeed anyone the facts, but I won't let myself be misled by lies wrapped up in pretty paper, either.
