There are probably a few "material witnesses" to the fact that it hasn't.

It would be going way too far to say that it hasn't survived. It's still doing a lot of good, but it keeps getting nibbled at day by day. Year by year, the courts have let more stuff get by.
Which is the best reason I at least somewhat like Clarence Thomas. Besides any personal type sympathies, dark rumors have surfaced of his general disregard for the importance of judicial precedent. This suggests that he's enough of a constitutionalist to be willing to overturn bad decisions.
In my fantasy land, at least, I could see Chief Justice Thomas being willing to lead the court in revisiting a lot of nonsense, including drug and gun laws.
Favoring constitutional textualism as your judicial standard rather than just starting out with whatever previous courts have let them get away with would be a fairly radical shift.
Then again, maybe I've just been breathing too much fresh country winter air.
