This is a news anchor for the most popular cable television news network fantasizing to hundreds of thousands of listeners about murdering a critic.
But O'Reilly couldn't legally murder Franken, as much as he obviously would like to. He also couldn't (successfully) sue for libel or slander, because O'Reilly knows there is a generous public record to back up Franken's claim that he is a "lying liar."
So he demanded that his employer, Fox News, file a lawsuit against Franken and his publisher for using the Fox-trademarked phrase "fair and balanced." Fox and O'Reilly were, of course, defeated in court. The judge declared the case "wholly without merit."
But it isn't enough that Fox News was defeated in court and compelled to withdraw the case. O'Reilly did not demand this case because it could be won. He demanded it because he wanted to teach Al Franken a lesson. His goal was to hobble the book's release. That plan backfired, of course ("Lies" shot up to #1 on Amazon and the publisher, Penguin Group, printed more copies).
But that's still not enough. Because there is a residual effect of this lawsuit. And that is, if you do not have the resources of Penguin Group, you may not want to fuck with Bill O'Reilly and Fox News, because they will take you to court. This is the message behind many lawsuits that attempt to stifle criticism by invoking trademark and copyright law. Many of these suits are also wholly without merit, but the purpose is not to win by winning--it's to win by intimidating.
The next critic of Bill O'Reilly may look at what happened to Franken and Penguin Group and say, not, "Great! The path is clear" but rather, "Why bother?" Especially if that critic stands alone and would not be able to muster the resources to counter a lawsuit even at the preliminary level.
And that's why it was so vital that I write and market a play in which Bill O'Reilly is tortured, raped and killed. A play that I feel captures the essence of Bill O'Reilly. A play that I will endeavor to see outlive Bill O'Reilly, so that O'Reilly's legacy is not his own forgettable works, but rather this one, in which I attempt to create a comic villain who achieves iconic status.

BTW, Bri, I believe you indeed capture the real O'Reilly. Reading that thing gave me the chills. I can imagine one day, decades hence, drama students will study Ionesco's "Leader," Moliére's "Tartuffe," Beckett's "Clov" and "Hamm," and Flemming's "Bill O'Reilly." Brian, that's such a cool idea; good on you for going for it and doing it so well.

Yes, my play presents both sides. O'Reilly rapes but he also gets raped, so there's a wide spectrum represented there, I think.

FTR, the accused often lose libel and trademark infringement cases at the trial level because jurors tend to be unsophisticated and easily manipulated. (Remember the ridiculous Oprah case?) Fox likely relied on such an outcome. It didn't make it out of the starting box though. And, now, great sales for the book are hammering home the message Fox should not have taken the gamble. Too bad they can't make O'Reilly pony up their legal fees, at least.

I bet he thinks he's a big shot now that he tried to humiliate O'Reilly. What does that say about him? That he's a jerk that treats people like shit. Al Franken still functions occasionally as a writer for SNL. And he may indeed behave like a jerk, but he's right about the lying faux president and his lying henchpersons.

Liz, have you read Franken's book? It is hard to question his proof if you haven't even bothered to read it.
And do you think O'Reilly puts on his show by himself? He has producers and researchers. O'Reilly seems to take more pleasure in humiliating people than Franken (who thought he was a bigshot long before anyone had even heard of O'Reilly).
