When I started to read this book, I was expecting a dry book about the trials and tribulations of patents and the patent process–I was so wrong. Clear and Convincing Evidence: My Career in Intellectual Property Law by George Gerstman is a very interesting and informative book.
It was not at all what I expected it to be. The stories Mr. Gerstman tells are some of the most intriguing and fascinating that I have ever heard. They were not all about patents and patent infringement; some were a bit amusing as in the story of the Naked Lady, about a client whose wife wanted to perform naked at a concert hall. Mr. Gerstman helped out the client and the show went on, almost.
There is much more to Clear and Convincing Evidence than just related stories about patent law. Each story that the author tells explains what the court case was about and what was happening in the discovery stage. When the trial was held, the author indicates where the trial was held, the name of the district court or federal court, the judge’s name, the location of the court, and the name of the opposing counsel. He is meticulous in how he explains the whole procedure so that the lay person can understand. There were a few Latin phrases (Legalese) that I had to look up, and that was a bit of a detriment, but otherwise it was a very well-told story. The thorough explanation of every case is well clarified by the author, making for a very easy read.
I enjoyed Clear and Convincing Evidence and give it one of my highest marks of a B+. The writing is concise, refreshing and a comfortable read for a general audience. There is nothing that is R rated or off color and I would recommend it to anyone interested in law. It does not matter what branch of the legal system your interest lies in, if being a Barrister is in your future, then this is a must read.Powered by Sidelines
